Terms of Use Statement for the E-Teachers Academy's Website

Please read these terms and conditions carefully before using our services as they contain important information regarding your legal rights, remedies and obligations. With enrolling to our program and/or a payment, these terms of use will be seen as accepted and binding.

1. The use of this website

These terms of use set the rights and obligations of ETeachersAcademy.com, the users, the registered students and of other third parties.

By confirming that the users and/or the registered students have read these terms and conditions and by continuing to sign up for the services of ETeachersAcademy.com they are notifying their acceptance of these terms and conditions and agree that they should be binding in all circumstances and shall be applicable to their use of the service provided by ETeachersAcademy.com.

By agreeing to the term of use of the ETeachersAcademy.com website, the users and/or the registered students certify that they have an age of 18 years or older and can form legally binding contracts under their applicable law.

If the users and/or registered students do not agree to these term of use, they should immediately cease all usage of the ETeachersAcademy.com website.

ETeachersAcademy.com reserves the right to modify, alter or update these term of use at any time. Modifications will become effective immediately upon being posted at http://www.ETeachersAcademy.com/terms.html.

The continued use of the service of ETeachersAcademy.com after amendments are posted constitutes an acceptance of the new term of use and their modifications.

Except as provided in this paragraph, these term of use may not be amended. The users and/or registered students are recommended to regularly review the term of use of the ETeachersAcademy.com.

2. The Description of the Service

ETeachersAcademy.com provides registered users of this site with screencasts and webinars about education 2.0 through its website or a virtual classroom environement provided by www.DimDim.com.

Live webinars have a duration between 30 minutes and 60 minutes.

The students must provide all the equipment necessary e.g. Personal Computer, Headset, PayPal or Moneybookers Account for the payment and Internet Connection.

The students have to pay for any aditional fees related to their connection to their provider.

3. Enrollment to the Program

In order to enroll to the program, students have to pay a one time fee of 99 Euro and register an account at http://campus.eteachersacademy.com.

After the payment has been received this account will be verfified and unlocked by the admin of ETeachersAcademy.com. The verification shall not be later than 12 hours after the payment has been received.

After being verified the student has full access to all screencasts, webinars, recordings, discussions and other content on ETeachersAcademy.com for one year. After that period the membership can be renewed for another year.

Regarding technical problems, refer to article 9. Limitation of Warranty of the term of use.

4. Cancellation and Refund of the Enrollment

The Enrollment can be cancelled within 30 days.

A full refund will be given by ETeachersAcademy.com not later than 48 hours after the cancellation.

Cancellations are accepted via email to cancellations@eteachersacademy.com.

After 30 days no refund can be given.

Regarding technical problems, refer to article 9. Limitation of Warranty of these term of use.

5. Personal Information

ETeachersAcademy.com commits to respecting the private life of its students. ETeachersAcademy.com commits to not selling, renting, trading or disclosing collected information of its students to any third parties.

The collected information remains confidential. ETeachersAcademy.com uses the collected information to answer your queries or complaints, to deliver our service (for example to test your level, to support your learning, to send you exercises), for administrative purposes, to improve our marketing and promotional efforts, to customize our website's content and services. We may use your email address to contact you regarding notices, surveys, new service offerings and communications relevant to your use of our website.

For all information given directly to ETeachersAcademy.com you are protected under the French Computer Science and Freedom law or Informatique et Liberté.

6. Copyright and Trademark Information

All content available on ETeachersAcademy.com, including site design, text, graphics, interfaces and illustrations are the property of the ETeachersAcademy.com and/or the third parties protected by intellectual property rights.

Any use of material of ETeachersAcademy.com, including reproduction, modification, distribution, or replication, any form of data extraction or data mining, or other exploitation of any kind, without prior written permission of ETeachersAcademy.com is prohibited.

The use of textual content of the exercises sent by email is only permitted for private and exclusive use of the registered students.

Registered students commit to not reproducing, distributing, selling, renting, publishing, or exploiting the exercises content for purpose other than those noted above.

7. Links to and from other Websites

The ETeachersAcademy.com website may include links to other websites that are owned and operated by online merchants and other third parties.

If you use these links, you leave the ETeachersAcademy.com website.

ETeachersAcademy.com does not control and is not responsible for these websites or their content or availability.

The use of these websites is subject to their own term of use and ETeachersAcademy.com is not responsible therein.

ETeachersAcademy.com does not endorse or make any representation about these websites, or their material, or any results that may be obtained from using them. ETeachersAcademy.com therefore encourages the students to review the term of use of each of these websites.

8. Disclaimer of Warranty

Registered students of ETeachersAcademy.com use its service and the services attached to it at their own risk.

ETeachersAcademy.com shall have no liability for any modification or interruption for the use of its website.

ETeachersAcademy.com reserves the right, at any time, to modify or interrupt its service with or without prior notice.

ETeachersAcademy.com disclaims all warranty with regard to the information provided, including the implied warranty merchantability and fitness for a particular purpose, and non-infringement.

Some jurisdiction does not allow the exclusion of implied warranty, therefore the above-referenced exclusion is inapplicable.

9. Limitation of Warranty

ETeachersAcademy.com disclaims all warranty that its online timetable corresponds to the registered members availabilities to book their lessons.
Nevertheless, we may provide time adjustments on request.

ETeachersAcademy.com disclaims all warranty regarding the occurrence of the following technical problems:
- The temporary impossibility to connect to the Internet,
- The temporary impossibility to connect to the website or some of its web pages,
- The break in the link between a teacher and a student through the video conferencing platform.

Concerning each of these cases above, ETeachersAcademy.com endeavours to do everything possible to restore the running of its service.

10. Limitation of Liability

ETeachersAcademy.com excludes all liability and responsibility for any amount or kind of loss or damage to you or a third party, and in particular ETeachersAcademy.com should not be liable for any direct, indirect, consequential, or incidental loss or damages, or any loss of income, loss of profits, loss of data, loss of contracts, loss of use, arising from or connected in any way to this website, the information contained in it, and the interruption of service, and whether in contract, negligence, tort, under statute, in equity, at law, or otherwise, even if ETeachersAcademy.com has been advised of the possibility of such damages.

Some jurisdictions do not allow for the limitation or exclusion of liability for incidental or consequential damages, therefore some of the above limitations is inapplicable.

11. Payment and Conditions of Payment

Registered Students can purchase their lessons by PayPal or by credit card through the ETeachersAcademy.com website. All prices mentioned are in Euros, tax included.

For each purchase, the student will receive an invoice by email.

For cancellations and refunds refer to article 4. Cancellation and Refund of the Enrollment.

12. Governing Law and Jurisdiction

ETeachersAcademy.com is operated and provided in France.

As such, ETeachersAcademy.com is subject to the laws of France. Those legal term of use shall be governed by and construed in accordance with the French law.

Disputes arising in connection with those legal term of use shall be subject to the exclusive jurisdiction of the French courts.
